1. Introduction

These Terms of Service (“Terms”) govern your access to and use of https://hardmoneylendersdallastx.com (the “Site”), operated by Hard Money Lenders of Dallas, a service of Lead Skills, LLC. By accessing or using the Site, submitting a form, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

Hard Money Lenders of Dallas operates a matching service that connects real estate investors with participating hard money lenders. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All such decisions are made solely by the participating lender.

We collect information you provide and share it with one or more participating lenders who may contact you about financing. We receive compensation from participating lenders for this service. Submitting information through the Site does not guarantee that you will be matched with a lender or receive a loan offer. Not all applicants will qualify.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer, commitment, or solicitation to lend. Rates, terms, fees, program availability, and funding timelines are set by each participating lender and may change without notice. Content on the Site is for general informational purposes only and does not constitute legal, tax, financial, or investment advice.

4. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. By using the Site or submitting a form, you represent that you meet these requirements and that any information you provide is truthful, accurate, and complete.

5. Your Consent to Be Contacted

When you check the consent box and submit a form on the Site, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text or calling (214) 997-0168. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lenders of Dallas connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, inaccurate, or misleading information
• Impersonate another person or entity
• Interfere with the operation of the Site or attempt to gain unauthorized access to any portion of the Site or its systems
• Copy, scrape, or otherwise reproduce the content of the Site without permission
• Use the Site in any way that violates applicable law

8. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Hard Money Lenders of Dallas and Lead Skills, LLC and is protected by U.S. and international intellectual property laws. You may not use our trademarks or content without our prior written consent.

Those third parties are independent of us, and we do not control or endorse their content, policies, or practices. Your interactions with any third party, including any loan agreement with a participating lender, are solely between you and that third party.

10. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, RELIABLE, OR CURRENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HARD MONEY LENDERS OF DALLAS AND LEAD SKILLS, LLC AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Hard Money Lenders of Dallas, Lead Skills, LLC, and their officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Dallas County, Texas.
